National Highways Limited · 30 Sept 2026 · Zen In Transition · Official notice

Rationale: Paragraph 6 of Schedule 5 of PA2023 is applicable as the following conditions are met in relation to the public contract: (a) due to an absence of competition for technical reasons, only a particular supplier can supply the goods, services or works required, and (b) there are no reasonable alternatives to those goods, services or works. Class 375 & 465 Simulator System Upgrade

    SE TRAINS LIMITED · 30 Sept 2026 · CORYS · Official notice

Rationale: The contract is an extension of the simulator infrastructure and resultant contract already in place whereby the supplier holds the intellectual property rights to deliver this requirement. An alternative supplier would not be able to integrate into the existing system already in place and as such, an entire fleet of brand new simulators would be required in addition to the development of new route maps applicable to the operating network of the contracting authority. In order to assure the competence of drivers, an homogenous train simulator experience is required which has influenced the intention to direct award this contract to ensure consistency across the current simulator estate.

  32. Direct award
    Ruislip Depot Development Opportunity

Places for London Limited · 29 Sept 2026 · BDW TRADING LIMITED · Official notice

Rationale: The LLP (controlled by BDW at the time of the transparency notice dated 11 June 2026) has exchanged contracts to acquire land at Ickenham comprising a site immediately adjacent to Places' land holdings. Places owned land adjacent to the land the LLP acquired in the vicinity of Ruislip Depot. Viability and site constraints meant that it was not feasible for Places to develop this land on a standalone basis. However, these viability issues and site constraints could be overcome if Places' land were combined with adjacent land and developed as part of a wider scheme. Therefore, Places (via its subsidiary, TTL) became a member of the LLP, and transferred its land in the vicinity of Ruislip Depot to the LLP. The LLP is responsible for seeking planning permission with the ultimate aim of developing the Site. The LLP has appointed BDW as the business and development manager, which is responsible for delivering the objectives set out in the LLP's business plan. TTL is a wholly owned subsidiary of Places for London Limited, which is the property owning arm of Transport for London. TTL is a contracting authority and subject to the Procurement Act 2023 when it awards public contracts. To the extent that Places' decision to become a member of the LLP (acting via its wholly owned subsidiary TTL) triggered the award of a public contract, Places considers that a direct award in accordance with section 41(1) of the Procurement Act 2023 was justified on the basis that the direct award justification in paragraph 5 of Schedule 5 applied. In addition and/or in the alternative, Places considers that the direct award justification in paragraph 6 of Schedule 5 applied. More specifically, Places considers that: • The BDW-controlled LLP had exclusive rights by virtue of its contract to acquire the immediately adjoining land to Ruislip Depot, such that it was the only supplier that Places could partner with to facilitate the development of Places' land in the vicinity of Ruislip Depot; and/or • There are technical reasons why the BDW-controlled LLP was the only supplier able to provide the required services. Specifically, no other supplier held, or was in a position to acquire, the specific parcels of land necessary to achieve a viable combined development with Places' land near Ruislip Depot. Places was also satisfied that there were no reasonable alternatives to participating in the LLP for the purpose of developing its land near to Ruislip Depot. In particular, Places concluded that publication of a tender notice would not trigger more competition or a better outcome, not least because the LLP was objectively the only supplier who could partner with Places to unlock the development of its land. This conclusion was based on the following factors: • it would not have been viable to develop Places' land in the vicinity of Ruislip Depot without combining that land with neighbouring land; and • the only plausible way to achieve that objective was to partner with BDW in the LLP. In particular, due to the location of existing railway infrastructure, roads, and RAF Northolt, Places concluded that there were no other parcels of land which could be combined with its land to create a viable regeneration scheme (other than the adjoining land the LLP had exclusive rights to acquire). Places also considered whether there were other parcels of land which Places could acquire via a competitive procurement but concluded that no such parcels of land existed (or were available) that would enable Places to develop its land on a viable basis. In accordance with section 41(4) of the Procurement Act 2023, Places has verified that BDW is neither an excluded nor an excludable supplier.

  38. Direct award
Technical Support Provider to the Power Purchase Agreement (PPA) Pilot Programme

Defence Infrastructure Organisation · 29 Sept 2026 · KPMG LLP · Official notice

Rationale: The Authority seeks to directly award this requirement to KPMG on the basis that the services constitute additional services closely linked to, and a continuation of, support already being delivered under existing arrangements in relation to the PPA Pilots Programme. KPMG has provided specialist technical, commercial and legal support throughout the development of the PPA pilot activities and has established significant subject matter expertise, understanding of MOD requirements, and knowledge of the emerging procurement strategies. As part of this work, KPMG is currently developing key programme documentation, commercial artefacts, evaluation materials and negotiation approaches with support from its specialist legal and technical advisors. Engaging an alternative supplier at this stage would require a significant transfer of knowledge and duplication of work already undertaken. This would result in additional cost to the Authority through procurement activity, onboarding, familiarisation and redevelopment of existing outputs. It would also create a risk of delay to critical programme milestones and adversely impact the Authority's readiness for the next phase of procurement and supplier engagement. The continuity of KPMG's support provides the most efficient and effective means of maintaining programme momentum, preserving the value of work already completed, and ensuring that ongoing activities are delivered in a coherent and consistent manner. Furthermore, KPMG's established understanding of the programme reduces delivery risk and supports the timely achievement of MOD objectives. A direct award in these circumstances represents the most economically advantageous approach, avoiding unnecessary duplication of effort, minimising programme risk, and ensuring continuity of specialist expertise during a critical phase of the PPA Pilots Programme.

    715890510_Arrestor Systems

Defence Equipment and Support · 29 Sept 2026 · Marshall Land Systems · Official notice

Rationale: The Support Capabilities and Commodities Team within the National Armaments Director Group (NAD) , part of the UK Ministry of Defence (the “Authority”), intends to extend contract ACCOMM/00087 (the Contracts) for the Provision of Engineering and Logistic Support to Aircraft Arrestor Systems in use in the UK and at overseas military bases – Rotary Hydraulic Arrestor Gear (RHAG) and Portable Hydraulic Arrestor Gear (PAAG) and contract ACCOMM/00035 (the Contracts) for Arrester Barrier with Marshall Land Systems Ltd (“Marshall”). The extension will be for 24 months with an estimated value for the extension period only of £5.6 million excluding VAT. The two contracts were competitively let, and the Authority will combine the two contracts into one as part of this extension. It is considered that an extension can be placed under Section 41 of the Procurement Act 2023 because the direct award justification specified in paragraph 7 of Schedule 5 (single supplier – additional services) applies. The Arrester Barrier System is obsolete; Marshall, as the incumbent, has the necessary technical understanding of the Arrester Barrier System, Suitably Qualified and Experienced people, and access to the technical drawings and approved repair instructions from the OEM to provide the service. As such a change in supplier would result in the Authority receiving services that are both different from, and incompatible with, the existing services. Due to the age of the equipment, only Marshall holds the necessary technical information, know-how, and expertise, and can provision the required compatible spares. As such, the difference and incompatibility of a different supplier’s services would result in disproportionate technical difficulties in operation and maintenance of the Arrester Barrier System.
