Leicestershire Partnership NHS Trust · 2 Oct 2026 · Priory Group Limited (NTN) · Official notice
Rationale: Leicestershire Partnership NHS Trust are awarding the contract named within this notice under the Direct Award A process which is outlined within the Health Care Services (Provider Selection Regime) Regulations 2023. The provider named in this notice is an existing provider and has been reviewed through a Key Criteria assessment to ensure the awarding body is satisfied with current performance and reasonably expects the provider to be able to satisfy the contract which is the subject of this notice. The contract which is the subject of this notice has not changed considerably when compared with the existing/previous contract delivered by the named provider. There is an existing service. There is no realistic alternative to the existing provider due to the nature of the health care services. Direct Award B would not apply, as patients do not have a choice of provider. Due to the nature of the health care services, patients are typically placed based on bed availability and clinical presentation, therefore there are limitations to patient choice.
GENOMICS ENGLAND LIMITED · 2 Oct 2026 · UK BIOCENTRE LIMITED · Official notice
Rationale: The delivery of services under a new contract with the existing supplier is proposed in accordance with Schedule 5, Paragraph 7 of the Procurement Act 2023, which enables a direct award where a change of supplier would result in incompatible goods or services and where such incompatibility would give rise to disproportionate technical difficulties in operation or maintenance. The remaining activity represents a continuation of established work already underway within the programme, and the new contractual arrangement does not introduce any additional or materially altered services. Transitioning to an alternative supplier at this stage would require substantial changes to embedded methodologies, operational processes and systems integration, resulting in significant incompatibilities with the established technical approach. Crucially, a change of supplier would also necessitate the transportation of a substantial volume of biological samples to a new provider. This introduces a material and unacceptable risk of contamination, loss, degradation or compromise of sample integrity, given the heightened handling requirements, increased logistical steps, and the sensitivity of the sample types involved. Such risks would directly threaten the comparability, consistency and scientific validity of programme outputs. Managing these transportation risks-alongside the need to migrate complex datasets, workflows and sample handling processes-would introduce disproportionate technical difficulties, as anticipated under Schedule 5, Paragraph 7, and would undermine the robustness of the study's established operational and analytical frameworks. Maintaining service delivery with the incumbent supplier therefore ensures continuity of technical methodologies, operational processes and quality controls, safeguarding the reliability and stability of the remaining programme work. In these circumstances, awarding a new contract to the existing supplier meets the criteria under Schedule 5, Paragraph 7, as a change in supplier would result in incompatible services and introduce unreasonable and disproportionate technical and logistical difficulties. The direct award is therefore the most appropriate, proportionate and compliant procurement route under the Procurement Act 2023.

Board of Trustees of the Royal Botanic Gardens Kew · 2 Oct 2026 · PhenoKey B.V. · Official notice
Rationale: Royal Botanic Gardens, Kew intends to award this contract directly to PhenoKey B.V. under section 41(1)(a) of the Procurement Act 2023. The authority considers that the direct award justification relating to intellectual property and exclusive rights applies because the requirement depends upon patented and licensed technology that can only be supplied through PhenoKey B.V. Evidence obtained by the authority confirms that the required solution relies upon protected methods, proprietary software, algorithms and associated intellectual property rights that are necessary to deliver the required functionality. The authority has concluded that no other supplier can lawfully provide access to the required combination of technology, licences and associated services. The authority also considers that the direct award justification relating to technical reasons applies because only PhenoKey B.V. can provide the required phenoTest 3D X-ray computed tomography platform and there are no reasonable alternatives. The requirement includes non-destructive longitudinal phenotyping of individual seeds and seedlings, integration of proprietary hardware and software, and compatibility with previous Kew research. The platform has been validated for the species required by the project and is required to generate comparable research outputs within the project timescales. Alternative suppliers, products and methods would not provide the required combination of technical capability, validated performance, intellectual property access and research comparability. The authority considers that the exclusivity arises from third-party intellectual property rights and essential technical requirements rather than from any artificial narrowing of the specification. Supporting patent, licensing, technical and no-reasonable-alternatives evidence is retained on the procurement file.

Rationale: PSR Direct Award C. The provider met the basic selection criteria in accordance with Regulation 19 of the Health Care Services (Provider Selection Regime) Regulations 2023 by achieving a pass. The provider also passed the assessment of exclusions (Exclusion Grounds - Grounds for Mandatory Exclusion and Exclusion Grounds - Grounds for Discretionary Exclusion) in line with Regulation 20 of the PSR. In addition, the provider achieved the required standard against PSR's five key criteria, and the new contract does not breach the considerable change threshold for a Direct Award C agreement.

Stevenage Borough Council · 2 Oct 2026 · WENTA BUSINESS CENTRES LIMITED · Official notice
Rationale: By way of a Tender Notice issued on 23 January 2026 Stevenage Borough Council (Council) commenced a single stage tendering procedure (an open procedure) pursuant to section 20 of the Procurement Act 2023 (Act) inviting tenders for the Provision of Property Management Services and Business Support Services at the Business Technology Centre (BTC), Bessemer Drive, Stevenage, SG1 2DX and Chells Industrial Units (CIU), The Glebe, Chells Way, Stevenage, SG2 0LQ. The Tender Notice identifier is 2026/S 000-006245 and a link to the Tender Notice is available at https://www.findtender.service.gov.uk/Notice/006245-2026?origin=SearchResults&p=1 The tender process was a competitive tendering procedure under section 20 of the Act and the deadline for the receipt of tenders was 27th February 2026. No tender submissions were received in response to the Tender Notice. As the Council has carried out a competitive tendering procedure and received no suitable tenders in response to that tender process, it is permitted to award a contract directly to a supplier (that is not an excluded supplier) pursuant to section 43(1) of the Act where it considers that an award following a competitive tendering procedure is not possible. Given that no bids were received in response to the Tender Notice, the Council is satisfied that an award following a competitive tendering procedure under section 19 is not possible in the circumstances and the Council now intends to award a contract directly to Wenta Business Centres Limited under section 43(1). The chosen supplier is currently providing the services. The council has carried out checks to ensure the chosen supplier is not an excluded supplier within the meaning of the Act. As part of its decision to make a direct award under section 43(1), the possibility of carrying out a further tendering procedure has been considered. The Council is satisfied that time constraints would make it highly challenging to maintain the continuity of service at the BTC and CIU if the Council retendered and there is also a high probability of attracting an identical outcome with no suitable tenders which would leave the Council with no operator when the current contract expires.
